Acceptance of Terms

By accessing or using Offbookd, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

Description of Service

Offbookd is a scheduling and availability coordination platform designed for casting professionals, talent agents, and actors. We provide tools to manage bookouts, holds, availabilities, and casting schedules.

License to Use

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use Offbookd for your business or professional purposes. You may not sublicense, distribute, or make our service available to third parties.

User Accounts

To use Offbookd, you must:

• Create an account using accurate information
• Maintain one account per individual (no shared accounts)
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized account access
• Use the service only for lawful purposes

You are responsible for all activity that occurs under your account.

Payments and Billing

Agency Subscriptions

Agency subscriptions are processed through Stripe and billed on a recurring basis:

• Billing cycles are monthly or annual as selected
• Payment is due in advance for each billing period
• You are responsible for all applicable taxes
• No refunds except where required by law
• You may cancel your subscription at any time through Stripe or by contacting support
• Upon cancellation, service continues through the end of the current billing period

Actor Access

During our pilot phase, actor access may be provided at no cost. In the future, we may implement a freemium model with usage limits (such as 3 event creations before requiring an upgrade). Any changes to pricing will be communicated in advance.

Beta/MVP Service

Offbookd is currently in beta/MVP phase. Our service is provided "AS IS" and features may change, be discontinued, or experience downtime. We may temporarily suspend the service to protect system integrity or perform maintenance.

Acceptable Use

You agree not to:

• Use our service for any unlawful purpose or in violation of any applicable laws
• Abuse, harass, or harm other users
• Send spam or unsolicited communications through our platform
• Scrape, crawl, or use automated tools to extract data from our service
• Attempt to reverse engineer, decompile, or hack our platform
• Interfere with the proper functioning of our service
• Upload malicious software or engage in any security-related misconduct

Intellectual Property

Our Rights

Offbookd and all related technology, software, and content are owned by Casting Stats LLC. All rights not expressly granted to you are reserved.

Your Content

You retain ownership of any content you upload to our platform. However, you grant us a worldwide, royalty-free, non-exclusive license to use, store, and process your content as necessary to provide our service to you and your authorized users.

Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Fail to pay required fees
• Engage in conduct that harms our service or other users

You may cancel your account at any time by managing your subscription through Stripe or contacting our support team at hello@offbookd.com.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFFBOOKD IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CASTING STATS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Offbookd shall be resolved in the courts of Wyoming.

Changes to Terms

We may update these Terms of Service from time to time. We will notify users of material changes by posting the updated terms on our website and updating the effective date. Your continued use of the service after changes take effect constitutes acceptance of the new terms.
